Escrow is a term that describes the neutral third party who controls payments between two parties and only releases the funds involved once a contract’s terms are met. The third party temporarily holds money, paperwork for a transaction on their behalf until the agreement has been met.
Escrow holders will charge fees that commensurate with the costs of providing the service, the liability undertaken and the overhead expenses which include a profit factor. Fees will vary between companies and from county to county. We follow the minimum fee schedule, which will provide for extra charges based upon the differing elements of your escrow.
The escrow holder has no control over the costs of other services that are obtained, such as the title insurance policy, lender’s charges, insurance and recording charges. We can provide you with an estimate of fees upon request.
If the escrow fails to close because of Seller’s default, Seller shall be liable for all customary escrow cancellation charges. If the escrow fails to close because of Buyer’s default, Buyer shall be liable for all customary escrow cancellation charges. If the escrow fails to close for any other reason, Seller and Buyer shall each be liable for one-half (1/2) of all customary escrow cancellation charges.
Whether you are the Buyer or the Seller, the biggest benefit is you will be protected during a real estate transaction. Your escrow officer will make sure no funds or property will change hands until all of the instructions in the transaction have been followed.
Escrow Instructions define all the conditions that must occur before the transaction can be finalized. Your escrow instructions represent your written statement to the escrow holder protecting your interests. They authorize the escrow officer to order title insurance which provides ownership protection to your new home. Be sure to return your escrow instructions and forms as soon as possible.
The closing of the escrow will take place when all instructions have been complied with and both sides of the transaction have fully performed. After all funds have been collected, the property title can be transferred. Once the documents are recorded with the county, title is transferred and escrow is considered closed. Recorded documents and new title policy will be mailed to you after closing from the county and title company.
